UN is aware Gota trespassed on laws and war crimes were committed when issuing orders irrespective of any other available evidence

According to recent reports, the UN Organization is aware based on reasonable suspicion irrespective of other available evidence, that the Defense Secretary Nandasena Gotabaya Rajapakse had exceeded his legal limits , acted over and above the officers officially giving commands and trespassed on the laws when issuing orders during the war thereby committing war crimes and violating human rights then and now.

It is learnt that the reason for this suspicion is based on the ugly and deplorable protests which were organized against the UN office in Colombo on the 09 July 2010 , as related by the UN chiefs themselves . On that day morning none other than anti democratic regime Minister & one who involved in a bribe case during 2010, Wimal Weerawansa along with a violent gang of goons laid siege to the UN office and staged demonstrations , and later even erected a stage near the UN office and performed a fast unto death .

It is an internationally accepted legal requirement that every country where the UN offices are situated, security for those offices should be provided by that country , and SL is also bound by that . It is the DIG of that area who is responsible to provide security to that Institution. He has no need to take instructions from anyone when it comes to providing security. On that day , the DIG Pathirane who was responsible arrived at the scene with a group of policemen ,when Weerawansa telephoned defense Secretary Gotabaya and complained during the violent scenes against the police seeking to establish peace and order. The Defense Secretary who then telephoned the DIG began furiously berating him as follows :

Gota : Who asked you to go there ? Don’t step into that area. Why did you go there ?
DIG Pathirane : ‘Sir, Sir …. IGP only told me to visit the scene.
Gota : Take the police and vanish from there immediately.
DIG : Yes Sir. I shall.
Gota: withdraw every police vehicle and get out.
DIG : Right Sir.
Gota : useless piece of work. Today itself IGP should be removed from there.



This episode became known to the whole world following the video footage . This was a clear demonstration of the unlawful orders issued by the defense Secretary overriding the officers who were truly eligible to duly give commands. As this order was given by Gota , one of the Weerawansa stooges taking advantage gave a blow to the high ranking law enforcing officer’s head that the much respected official cap of his got thrown to the ground.



Consequently , the UN top rung officials have reasonably concluded based on justifiable suspicion that if this defense Secretary who is expected to be in full overall charge of the law and order situation of the country is so blatantly , in broad daylight and with complete impunity breaking the laws giving orders which are in absolute violation of legal precepts and is disdainfully overriding the law enforcing authorities , the mounting allegations of war crimes , human rights violations then and now committed in SL should be given credence to and are to be expected..

It is noteworthy ,legally , a defense Secretary post is not a position where any official orders can be issued to security divisions.

General Fonseka to be blamed for War Crime Charges - Plan by Anti Democratic Regime Surfaces !


A special operation has commenced under the Anti Democaratic Leader's Secretary to blame former Army Commander, General Sarath Fonseka for the war crimes that have allegedly taken place according to the international community during the final stages of the war (yet to be prooved though)

The Leader's advisors are planning on giving publicity to open statements made by General Fonseka. The Leader's Secretary has asked the Media Minister to collect all comments made by General Fonseka while in the Army and after retiring from active service.

It has been decided to use the statement made by General Fonseka after retiring from the Chief of Defence (COD) Staff post where he has said that the leader did not have any clear plan on winning the war and that the only contribution by leader was to provide the necessary bullets.

He has also said the guns, tanks and multi barrel rocket launchers were all purchased during former President Hon. Chandrika Kumaratunge's tenure and that Mahinda Rajapaksa had only provided the bullets.

The Defence Secretary has advised that the operation be carried out in a manner that would not place all credit of winning the war on General Fonseka who was one of the 3 persons involved in impriosoning General Fonseka (Other too are current leader and Ranil).

In order to minimize the allegations of war crimes leveled against the Leaders, his secretary Lalith Weeratunge in an interview with a weekly newspaper said that Rajapaksa did not have any intension of engaging in a war until the LTTE closed down the Mavilaru aniket and commenced the Eelam IV war.

Weeratunge has said that he was shocked when he heard the President tell the special peace envoy Erik Solheim that he was ready for a war.

But many political analysts believe that most probably their will be no issue for General Fonseka (if war crimes are true) as he is being harrased by Mahinda and his regime and he was in China during the final stage ( where UN says war crimes did take place, yet to proove though !) and Gotabaya was the one who was invovled in it with Mahinda.


Also their is a risk for Gotabaya as USA can take legal action against him at any time as he hold the US Citizenship. Mahinda will find it difficult, if he doesn't get support from India to counter attack the charges. Any way it was the regimes foolish decisions (e.g White Flag Case put on SF ) after the war that had lead to all these problems as they were trying to gain political advantage to win elections.

3 key figures in Anti Democaratic Gaddafi's regime will have to face WAR Crimes for crimes against humanity in Libya

The chief prosecutor for the International Criminal Court (ICC) has told the UN Security Council that he will seek three arrest warrants for crimes against humanity in Libya.

Charges against the three members of the Libyan government may include murder and unlawful detention, use of cluster bombs and rape as a weapon, Luis Moreno-Ocampo said on Wednesday.

The UN Security Council referred the Libyan violence to the ICC in February.

Moreno-Ocampo is investigating Libyan leader Muammar Gaddafi, some of his sons and aides over a "pre-determined plan" to attack protesters.

He did not, however, name the targets of the arrest warrants, which he said he will request in several weeks for crimes against humanity committed in Libya since February 15.

"Crimes against humanity have been and continue to be committed in Libya, attacking unarmed civilians including killings and persecutions in many cities across Libya," the prosecutor said in a statement.

The prosecutor added that he was also investigating the deaths of dozens of sub-Saharan Africans in the rebel capital of Benghazi by an "angry mob" who believed they were mercenaries for Gaddafi.

Khalid Kaim, the Libyan deputy foreign minister, dismissed the ICC allegations saying Moreno-Ocampo's report painted a partial picture.

"Any decision or any conclusion can Mr. Ocampo draw out of his visit to Benghazi and to Egypt will be just one party review or one party position," Kaim said.

"Of course, since we are not party of the ICC, we cannot invite Mr. Ocampo but instead of that we can invite another fact-finding mission from the [UN] Security Council."

Rape as a weapon

Moreno-Ocampo said there were allegations that Africans from other nations had been attacked in rebel territory because they were thought to be mercenaries.

Alleged criminal incidents include security forces opening live fire at unarmed peaceful protesters, using rape as well as "systemic arrests, torture, killings, deportations, enforced disappearances and destruction of mosques" as a weapon, according to the prosecutor's report.

While a precise number is hard to provide, up to 700 people were killed in February alone, the report said. Gaddafi estimates that "only 150 or 200" have been killed.

The United Nations High Commissioner for Refugees has said almost 40,000 people fled fighting in western Libya last month.

International Investigation ONLY if majority of member states agree - says UN Chief Ban Ki-moon

UN Chief Ban Ki-moon says he will only launch an international investigation into allegations of possible war crimes taking place at the final stages of the war in Sri Lanka that ended in May, 2009, if the member states agree.

After releasing the Expert Panel report on Sri Lanka a UN statement said “the secretary-general has been advised that this (international investigation) will require host country consent or a decision from Member States through an appropriate intergovernmental forum.  The monitoring and repository functions it was suggested this mechanism undertake will continue to be performed by the United Nations Secretariat.”

However the Ban’s statement didn't mention a forum but it could include the U.N. Security Council, General Assembly or Human Rights Council.

The panel's report called for an investigation of the Sri Lankan government and Tamil Tiger rebels, as it stated that tens of thousands of the final 2009 offensive against Tamil separatists may have resulted from war crimes.

The UN Chief also said that there would be an inquiry into United Nations' actions during the last stage of the war.
“The Secretary-General has decided that he will respond positively to the Panel’s recommendation for a review of the United Nations actions regarding the implementation of its humanitarian and protection mandates during the war in Sri Lanka — particularly in the last stages. The exact modality of such a review will be determined after consultations with relevant agencies, funds and programmes,” the statement added.

The 200-page report of a three-member panel, that made public, “found credible allegations” of violations of international humanitarian and human rights laws by both sides. The report also said UN “political organs and bodies failed to take actions that might have protected civilians,” including public use of casualty figures.

The report cited evidence that a “wide range of serious violations of international humanitarian law and international human rights law was committed both by the government of Sri Lanka and the Liberation Tigers of Tamil Eelam, some of which would amount to war crimes and crimes against humanity.”

Panel of experts finds credible reports of war crimes during Sri Lanka conflict – UN says

The panel of experts set up to advise Secretary-General Ban Ki-moon on accountability issues with respect to the final stages of the conflict in Sri Lanka has found credible reports of war crimes committed by both the Government and Tamil rebels and calls for genuine investigations into the allegations, according to a report made public today by the United Nations.

The decision to release the report, which was submitted to the Secretary- General on 12 April and shared with the Sri Lankan Government, was made as a “matter of transparency and in the broader public interest,” Mr. Ban’s spokesperson said in a statement.

“The Secretary-General sincerely hopes that this advisory report will make a contribution to full accountability and justice so that the Sri Lankan Government and people will be able to proceed towards national reconciliation and peace,” the statement added.

Mr. Ban is carefully reviewing the report’s conclusions and recommendations, “including its disturbing assessment that a number of allegations of serious violations of international humanitarian and human rights law committed by both the Liberation Tigers of Tamil Eelam (LTTE) and the Government of Sri Lanka are credible, some of which would amount to war crimes and crimes against humanity.”

“In regard to the recommendation that he establish an international investigation mechanism, the Secretary-General is advised that this will require host country consent or a decision from Member States through an appropriate intergovernmental forum,” the statement added.

The three-member panel of experts was set up following the Joint Statement made by Mr. Ban and Sri Lankan President Mahinda Rajapaksa after the Secretary-General visited the South Asian nation shortly after the end of the conflict.

The members of the panel were Marzuki Darusman of Indonesia (chair), Yasmin Sooka of South Africa and Steven Ratner of the United States. They began their work in September 2010.
